FATAL ACC INQUIRY A SAD DAY FOR JUSTICE

by Ron Beaty - 12:57 on 10 March 2010

YOU WILL FIND THE DETAILS HERE

BEFORE I START I WOULD QUESTION THE POLICE & POSSIBLY THEIR COMPUTOR PROGRAME used, being like all computors it only uses the information fed it. If its flawed, so is the out put gave evidence stated
One policeman stated.

So the fact a woman of 53 could not put the same pressure on a brake pedal as someone younger.
So what they are in effect saying is,older folk cannot put proper pressure on a brake pedal.

If this is the case millions of us should not be driving

Don't all cars now have ABS or at the least servo braking , that compensates  for poor pressure ???. Utter garbage
I WOULD ADD TO THE SHERIFFS COMMENTS

[24] Mr. Beaty feels strongly that many accidents involving school transport come about because drivers do not pay sufficient attention to school buses.
This would be why over the years, so many pupils have been killed or injured

As I understood his evidence he believes this is because, at least in part, of inadequate signage on these buses.
It surely speaks for itself, yes one of the reasons

[25] Presently each local authority determines what signs should be on school transport, subject to certain statutory minimums laid down by the Westminster Parliament.

Mr. Beaty would like to see all authorities required to use the same signs so there would be no confusion from area to area.

They all use the same signage, that is laid down by Westminster, so where does this come from, it’s removing the signs that’s the problem.

He would also like strict adherence, by contractors, to the requirement that signs were not displayed when the vehicle was being used for other purposes.
This is correct, any one with a modicum of common sense would not use a sign, designed for one purpose but allow it to be used for another.
Surely in the knowledge that in time, all reason for the sign would be diluted through misuse!

(27)   In addition Mr. Beaty would like to see the law changed to forbid the overtaking of stationary school buses by other vehicles. This was the law, he said, in many states in the USA. Both the Procurator Fiscal and the court pressed him, gently, on this proposal and it became clear that this is, at best, an idea in progress.
He was unsure, for example, whether the prohibition would apply to emergency vehicles or to buses which were wholly off the carriageway in designated bus stop.

Once again I would say, I am not an expert on road safety matters, & in fact have never claimed to be, I am a grandfather trying to ensure other families do not go through the same pain ours & others have.
I am sure however any USA law could be improved on & modified for the UK.
We here others speak for UK laws, who are not experts either.
PLEASE READ ON

SHERIFF FLEETWOOD HAS GIVEN NO RECOMMENDATIONS TO CARRY FORWARD, VERY SAD FOR HIM AS HE HAD THE POWER TO SAVE LIVES & INJURIES.

After all the evidence he heard regarding school bus safety & of how safety can be improved, Sheriff Fleetwood still thinks otherwise.

After all how do you hear all the evidence & come to a decision of no recommendations within 11 days of the case being heard.

School transport could be much safer, the amount of injuries there are each year regarding school pupils, ignoring sadly the deaths, should tell anyone that.

That complacency over years is one of the main PROBLEMS re school bus safety, Local Councils UK wide & even Governments, who over years, have had the opportunity to change & improve school bus safety, even after fatal accidents, but never did so.

This failure to grasp the problem ensured the accidents continue to this day.

Bus companies carried on regardless over the years, they could have done so much more, been more actively involved. Alas no.

Maybe someone would like to explain why? but i doubt it.

In fact why after a school pupils death would nothing change; a death in a business would involve H&S.

Yet the simple fact is a pupil steps off a school bus & is killed or injured, &  nothing changes, this would not happen in any business or work place where a death occurred, there would be plenty recommendations from H&S regarding that accident .

Does this show the sheriffs lack of understanding, to me it does!
He found he could give no recommendations for the following & more.

[1] The point of fact that often vehicles do not show just regard that it’s a school bus unloading & often speed by.

[2] The safety sign is not always removed. [We have photos of this happening]

[3] Not all buses use headlights, nor in fact hazards. Although a bus driver told him they do, & the Sheriff chose to believe him.
We can prove the driver wrong time & time again!

[4] Local Councils can & do have differing safety measures throughout Scotland & in fact the whole UK.

[5] The safety sign can be masked by vehicles behind it
These are 5 he could have thought about & changed the outlook on.

It is only since we started to campaign, only after Robyn & Alexander were tragically killed & Erin left severely injured, that things started to move, slowly.

It seems that the Sheriff  is really unaware of what is actually going on, the fact the petitions committee is looking at school bus safety, should tell him there is a reason for that something is going on.

He apparently could not see, even after I explained the fact in court, the school bus safety sign is placed in different positions on different buses.
Usually so low it’s masked by a larger vehicle behind it, i.e. people carriers, van lorry etc.

That would be why Gillian Ansell did not see Robyn & the fact it was a school bus she was on .

The fact is she should of seen Robyn & the bus at a distance, she was driving, no one else!

Carla Oldham has asked me to add & i echo this
I know people might be sick to the back teeth of hearing about Robyn’s accident, but let Robyn serve as a constant reminder of what can happen.

There is no coming back from loosing a child, its not a game, its not a case of close your eyes and let life pass you by in a contented blur, its real.
Robyn is gone from our lives forever, and that breaks my heart in two. So I will continue to campaign for school bus safety
.................................

The fact the Aberdeenshire Council is now, after all these years, & in fact after the deaths & injuries in years past, is trying to improve safety, we congratulate them for doing so.
My only question, why did YOU wait so long to change things ?

But at least they are trying, as are Moray Council, what about the rest?
Do we continue to wait for another fatality or severely injured pupil.

I expect sadly it will only be only through a death once again, that we hear the words “Something must be done” as it echoes past once again!

TIME & TIME AGAIN OVER THE YEARS, AFTER EACH ACCIDENT WE HEAR “Something must be done”
THEN WHAT HAPPENED - NOTHING

I rest my case!

The reason we push for changes is simple, if we don’t, who does?

Yes there are other organisations that pursue road safety in general, but the law never changes.

We often wonder why you would teach road safety, teach children how to cross the road, as has been done for how long ? 40 odd years!
Yet not pursue a chance in the law, why?

There are charities, which teach road safety etc, but are not actively involved in getting laws changed. Why ?

So there we have it, the great debate is past, our thanks to Mr Hutchison the Fiscal for trying to help, & for allowing us the FAI in the first place.

It allowed problems to be aired, just a pity that the one person in charge, the one person who could have helped make a difference, failed to do so.

A pity we have a sheriff who cannot work out the rights & wrongs with in school bus safety, especially as others can see where the problems are.
We told him. We showed him, apparently it was not enough.

As Carla said “He had a chance to make a difference and he blew it, i can’t help feel sorry for him”

We are saddened but not surprised; we are past being surprised now.
We continue to do as we do until school pupils are properly protected, until all pupils have the same rights to safety.

Our prayer is lives are saved & injuries stopped, sadly I think circumstances will prove us right, it will continue to happen
