IT IS ILLEGAL & YOU NEED TO REPORT THIS TO YOUR COUNCIL, THE POLICE & BUS COMPANY. PROVIDING THE SERVICE

We are still waiting for the government to change the law to make it compulsory for children over 3 years old to wear seat belts on coaches & buses that have them fitted.
At this present time the law only applies to passengers 14 years and older.  
 
The delay is caused by applying the law to young children, & is total uncertain about who would be legally responsible.
 
It could not be the child passenger, it would be dangerous to make the bus driver legally responsible for ensuring that an 8 year old child in row 19 has his seat belt on.
The driver has to concentrate on driving
 
Although now with electric soft wear the bus could be made impossible to start until the belt was fitted.
 
This would bring that pupil into focus as regards the rest of the bus.
 
It  would seem likely that the government will make the coach operator or trip organiser responsible, but we are still waiting for the announcement.
 
But it drags on, if any Labour MP or MSP wishes to comment on this situation, we will be glad to publish it

SOME LAWS  ARE COMPLICATED , OTHERS ARE VERY COMPLICATED & OTHERS, WELL THEY ARE SO HARD TO FIND.

RULES
How is the 3 for 2 concessions on public service vehicles affected?

For PSVs there is a concession that allows three seated children under 14 years of age to be counted as two passengers.
 
From the 1 May 1996 this concession was limited to those seats that do not have seat belts.
 
This ensures that children in seats fitted with belts each have a seat belt. Therefore, any seat in a PSV, including a bus that has seat belts fitted will not be eligible for the concession.

Three for Two seating on a School bus
IT’S A SHOCKING & A VERY UNSAFE WAY TO TRANSPORT SCHOOL CHILDREN
 
Look at the seat, many have metal grab handles, three teenagers in one seat, three school children in one seat.
Some teenagers are the size of small adults, would you ask three adults to share a seat.
 
OF COURSE NOT, SO WHY ASK SCHOOL CHILDREN
 
WHY, money, nothing else, it’s to save money, it’s not about YOUR CHILD’S safety that’s a certainty!
 
IN 2002
A Department for Transport document recognises that across the UK... The 3 for 2 regulations should go.
This was in 2002, its still here.There ARE still some councils using it & we are trying to find them, they are however in a minority.
 
However, it is only supposed to used really in emergency situations,  3 for 2 was dropped by most councils, it is not supposed to be a long term cure for a council that cannot run, nor fund itself properly.
 
Not what you would call forward planning ? .
Lack of money, OR would rather spend money else where, but not on school transport
 
 
In 2002, this was said by British Safety Council
on Regulations to improve the safety of school buses and coaches are "riddled with loopholes that makes them nonsense",
 B.U.S.K & the British Safety Council  wants the "three for two" concession to end for all vehicles, thus ending the ability of some operators to legally carry more than 100 children in one vehicle at a time.
 
The BSC added: "If coach companies allowed such scandalous overcrowding for adults , they would quite rightly be prosecuted."
 
Exactly, once again we see what is not good enough for adults, is always good enough for a school children.
 
In some instances a school bus could in fact carry up to 80+ children

When Accidents are most likely to happen
2.11  The importance of journeys to and from school with respect to child casualties increases with the age of the children.
 
School journeys contribute 14.6% of all 5-7 year old casualties,
 
21.0% of all 8-11 year old casualties
and nearly 1 in 4 (23.9%) of all 12-15 year old casualties.
 
The accident rate for children peaks between 8am and
9am, when they are travelling to school, and again at 3pm when they leave.
 
 
 
 
I have searched for details of school children standing in a bus, never mind a school bus, & still cannot find what I am looking for.
 
However one reason comes to mind, if the child cannot reach any safety strap, or safely support themselves against braking, then I would deem it very unsafe, as I expect most parents would.

2.24 Parents have grave concerns about 'three for two' seating on school buses and overcrowding on service buses which means that pupils have to stand and risk being thrown forward if the driver had to stop suddenly. SO WHY IS IT STILL HAPPENING
 
2.25 The lack of seatbelts on school buses and service buses was a major concern to parents of all bus users and also one of the most commonly quoted reasons for not using buses, after poor availability of services.

IT’S A HUGE CONCERN AS THEY ADMIT SO WHY ARE THEY NOT FITTED TO OLDER BUSES.
 
IF BUS OPERATORS CONTINUE TO USE OLDER BUSES, SCHOOL CHILDREN WILL NEVER HAVE THE BENEFIT OF THE SAFETY OF SEAT BELTS THEY HAVE IN THE FAMILY CAR.
SURELY IF THEY SAVE LIVES IN CARS , THEY WILL SAVE LIVES  ON A BUS.

Rights and responsibilities
Responsibility for pupil’s behaviour, safety and security at the bus stop and walking to and from it lies by law clearly with the parents.
Responsibility for children being transported on school bus services is split between the transport operator and the party organising the service. In the case of LEA provision, if a child was injured as a result of negligence, the operator and the LEA would be liable.
Try proving negligence!!!!!
 
Escorts
Various schemes around the UK use paid escorts on school buses where there are problems with pupils' behaviour.
They are there to manage the pupils' behaviour and prevent them endangering other passengers or causing damage to the bus.
Escorts are not allowed to discipline pupils - they have neither the council's nor the parents' authority to do so.
 
Opinion is divided about their efficacy, some have found they reduce vandalism and help pupils realise the bus is "theirs".
Others argue that they are seen as a challenge and that funds can be better used on bus behaviour teaching programmes.

Every parent in the UK has to ask themselves, & in fact should be ASKING.
 
Is the school or local authority properly exercising its duty correctly.
Regarding the fact it & the bus company are responsible for your child’s safety whilst aboard the bus.
 
If that school or local authority allows 3 children sitting in a seat designed for 2, or if in fact they allow school children to stand on a bus.
None of this happens in our area as far as we are aware?
 
That many throught the UK don’t follow guidelines on safety as recommended by The Scottish Parliament, House of Commons or The Dept of Transport.
 
WE CAN TELL YOU MANY COUNCILS IN SCOTLAND & THE REST OF THE UK DO NOT OFFER A FULL PACKAGE OF SAFETY MEASURES.
 
THEY CAN DO MORE, BUT IT SEEMS THEY ARE CONTENT TO OFFER THE MINIMUM STANDARDS OF SAFETY FOR YOUR CHILD.
 
WILL THERE BE OTHER CHILDEN KILLED, WILL THERE BE OTHER SCHOOL CHILDREN LEFT INJURED & BRAIN DAMAGED?
 
WILL OTHER FAMILIES HAVE TO GO THROUGH THE ABSOLUTE HELL OF SUFFERING OURS & OTHERS HAVE?
